assalaamu alaikum

I just watched a program on BBC1 which sought to expose the extreme form
of Khul'a in Jewish Law, also known as a "get" divorce.

In orthodox Jewish Law a woman is not officially divorced from her
husband until he grants it to her in a written form and hands this piece
of paper to her before two witnesses.

The abuse of this law, they reported, is increasing exponentially,
whereby, Jewish men desert their wives and refuse to grant them a
divorce through Jewish Law UNLESS the woman pays the man a sum of money
which usually ranges from expensive to obscene - with some cases where
the man would only agree to grant the divorce if he received hundreds of
thousands of pounds in exchange.

The result for a woman who cannot afford this is that she is "left
hanging" - not being able to re-marry, thus, any other relationship
would be considered adulterous. Not only that but it would affect her
children, as they would be banned by orthodox Jewish Law from marrying
an orthodox Jew, and nor can their generation or the following
generation - up to 10 generations later marry an orthodox Jew.

Of course, in Islamic law, such an extreme situation would not be
permitted, and neither does the child carry the sin of the parent, nor
does any shoulder the sin of another.

So what did Rabbi Jonathan Sacks (Chief Rabbi of the United Hebrew
Congregations of the British Commonwealth) say in defence of this tragic
practice legitimised by his religion? He said (paraphrased) "This is
Jewish Law, and regardless of what *anyone* says, we will stick to it.
We are not taking the role of legislators who can change the Jewish Law
as we see fit, rather we are only the judiciary who *applies* it."

Similar statements were made by other leading Jews.

This made me so sad when i reflected upon the state of the Muslim
"leaders" of organisations in the West. How easy it is for them to
change the religion, and apologise for Allah's Laws whether it is Jihad
or polygyny, whereas, the Jews in front of the mass media are unafraid
to say that they will stick to their religion regardless of whatever
amount of pressure is placed on the rabbinate.

May Allah grant us better leadership and better followers. Ameen.
