Chechen Supreme Court Statement Regarding the Plan

The Chechen Supreme Court has released the following statement about the recent hijacking of [url=http://63.249.218.164/html/newshijackingreport.htm]Vnukovo Airlines flight 2806[/url]. All Praise is to Allah. Prayers and Blessings be upon the Messenger of Allah.

First, the hijackers of flight 2806 did not represent in any way the Mujahideen command. Although they were Mujahideen from Chechnya, they were acting upon their own initiative and their actions were not sanctioned from the Mujahideen leadership. The court has endeavoured to consider the issue according to the teachings of the Quran and had reached the following conclusions.

The hijacking of the plane was wrong and a mistake on behalf of the individuals responsible.

a). Such measures are not necessary. By Allah’s Grace, the Mujahideen have severely stretched the ability of the Russian military to contain this conflict. Every day Russian soldiers continue to be killed in Chechnya, military equipment is destroyed and the Russian Government is forced to plough more money into maintaining the campaign.

b). More importantly, such an action does not conform to the Shariah [Islamic legal system]. Hijacking the plane put the lives of Muslims in danger and targeted individuals who were provided a peaceful right of passage via an entry visa. No commander, no matter how good his intentions might be, is allowed to bypass the rules of the Shariah in the pursuit of the Jihad.

However, it is clear that these Mujahideen were pushed beyond the limits of their better judgement in circumstances that are far from reasonable. While we do not condone their actions, the court takes into account that the hijackers were individuals in a state of distress and desperation. Furthermore, the court has to point out the gross imbalance in regard to the crimes perpetrated by the Russian Government.

There is no other way to describe the behaviour of the Russian military in Chechyna than a orchestrated campaign of genocide and oppression. On innumerable occasions the military have made no distinction between the elderly, children, women or men. Many thousands of innocent civilians have been arrested, detained , tortured or killed with absolutely no evidence against them and no attempt made to find any. The Chechen population lives in widespread fear of the search and arrest operations in which civilians are kidnapped and ransomed for money.

The evidence of ongoing rape, murder, torture, looting and extortion is overwhelming. The non-specific shelling of civilian towns and villages is routine and the specific targeting of non-military buildings is irrefutable. The destruction of Mosques, Qurans and attempting to turn people away from Islam is a clear but unstated objective. Furthermore, these actions are carried out in the full knowledge and therefore with the complete authority of both the military and political leadership.

In this context, the actions of Russia in Chechnya are by far more worthy of criticism that a unwieldy attempt to hijack a plane by two beleaguered Mujahideen. We would urge that the judgement of the hijackers is resolved according to Shariah as opposed to the secular laws of Saudi Arabia or Russia. The pious religious leaders of the local area have the most right to hear the case, rather than the law courts of Russia or any other country.
