i have a problem , me and a shia girl have had a conversation
of getting married but the problem is her parents want her to marry a
man from their orig. country and also to be a shia, which on both cases
do not apply to me.  Would it be haram to marry this girl w/ out her
parents blessing?? What should i do????!!!!!!!

The discussion on girls getting married without their wali's approval we had on here before, Se7en can pull up the link. :)  The marriage is considered "batil" (invalid) by three of the four schools, with the exception being the hanafi school, but even then there were certain circumstances.  There was a good excerpt on this that was brought to my attention by Pacific Breeze in Al-Hedeya.

bhaloo, the case here is a little different.  The *girl* is a shi'ah, and the guy is a sunni.  And the question is posed by the guy, not the girl.

It'd be interesting to see what the shi'ah scholars say about this whole thing!  Is a shi'ah girl allowed, in their religion, to marry without the consent of their walee?  I know there's some shi'ah members on this board.  Can they provide some insight here?

Assalamu Alaykum,

I did a bit of research and consulted various knowledgeable people.

The concensus I got seems to be that the girl requires her guardian's permission in order for the marriage contract to be valid *except* in the case where the objections of the parents is not related to deen or character.  

If they are objecting on the basis of culture, race, etc. they are not fulfilling their responsibility as guardian and technically the girl is allowed to marry without her guardian's permission. But the parents reasons must clearly demonstrate that there objections are not based on deen or character.  

But keep in mind, realistically, it is not a good thing to start off a marriage with parents being upset. Try to reason with them or get someone they respect to talk to them.  May Allah make things easy for you and give you what is best for you in this life and next.

I am wary that this thread will turn into a sunni/shia debate which is against the constitution. There have been other threads where the subject of marriage against parents have been discussed. Please refer to those. This thread will be locked.
