Quick question,
When is a muslim allowed to kill another human? ie.under what conditions, circumstances etc

ps. this isn't personal ;)

Salaamun Alaikum,

The only situation we are allowed to kill another being is in the battlefields. We can refer to these verses in the Quran:

Yusufali 2:191 "And slay them wherever ye catch them, and turn them out from where they have Turned you out; for tumult and oppression are worse than slaughter; but fight them not at the Sacred Mosque, unless they (first) fight you there; but if they fight you, slay them. Such is the reward of those who suppress faith."

Yusufali 2:193 "And fight them on until there is no more Tumult or oppression, and there prevail justice and faith in Allah; but if they cease, Let there be no hostility except to those who practise oppression."

Fighting evil should continue until its power base is dislodged, after which it should be stopped. However we must also keep in mind and make it clear that the purpose of fighting in the way of Allah is to remove persecution, corruption and mischief which suppress liberty and do not allow people to choose between truth and falsehood so that they may willingly believe in Allah and follow His commandments.

I think after taking a look at the previous verses we should also take a look at the following verses:

Yusufali 2:190 "Fight in the cause of Allah those who fight you, but do not transgress limits; for Allah loveth not transgressors."

Yusufali 2:192 "But if they cease, Allah is Oft-forgiving, Most Merciful."

Islam promotes peace, order and harmony in the human society and keeps man on the right path. Showing mercy when one has the upper hand is enjoined in this verse (192). On all occasions, the lover of Allah attempts to draw near Him by taking on the appropriate attribute of Allah. Mercy and forgiveness for the enemies if they desist from fighting has been recommended. No other creed or religion has this provision.

We should only fight if theres stolen lands, oppression, corruption, etc. This is the case for Palestine, Lebanon, Kashmir, Chechnya, etc. I hope I helped you in answering you question. :)

This is a tough question to tackle, because it is a shar'ee question, and I don't think any of us are well-versed in the laws of Sharee'ah.  But this is what I know:

In *most* cases, the individual has no right to take any person's life (Muslim or non-Muslim).  It is the *state* that has the right to do so.  Unless the state gives permission to an individual to take another man's life, the individual cannot do so.  An example where the state may give such a permission would be in Jihaad.  

The exception to the above rule is defending one's life, property and honor.  If there is an attack on either one of the above, and there is no other means to defend it other than killing the attacker, then in that case it may be permissible as a defensive measure to kill him.  However, if there was an Islamic state in existence, such an act will definitely have to go through a trial.  In the absence of an Islamic state, the Judgment remains with Allah.  

If a life is taken without valid reason, whether that of a Muslim or a non-Muslim, it is a grave sin.  That much should be understood.  

As far as Jihad is concerned, there are two types of Jihad.  Offensive and defensive.  In the absence of an Islamic leadership which is chosen by the consensus of the believers, there is no offensive jihaad.

Per the rules of War & Islam, the following has been prohibited by Prophet
Muhammad:

1. Killing traders, merchants, contractors and the like are to be spared if
they do not take part in actual fighting (kharaj of Yahya p 34, Kharaj of
Abu Yusufp 122)

2. Killing non Combatants (Mabsit of Sarakhisiy, X, 64)

3. Combatants are only those who are physically capable of fighting (Sharhj
al siyar al kabir, IV,78).

4. Killing women (Idem, I, 59, 34), minors, servants, and slaves who
accompany their masters yet do not take part in actual fighting (Sharhj al
siyar al kabir, IV, 79-80), the blind (Mabsit of Sarakhsiy, X, 69), monks
(Sharhj al siyar al kabir, I, 33), hermits (Idem, III, 190), the very old
(Mabsut of Sarakhsiy, X, 6), those physically incapable of fighting (Idem,
p69), the insane or delirious (Mabsut of Sarakhsiy p 69)

5.  Killing peasants when they do not fight and the result of war is
indifferent on them (Idem, IV, 79; for order and practice of Abu Bakr see
Tabari 2026, 2031; for Umar see Ibn Rush Bidayah alk Masjtihad I 311)


And Allah the Almighty states in the Quran:
"Fight in the cause of Allah those who fight you but do NOT transgress
limits; for Allah loveth not transgressors"
[Surah al Baqara (2): 190]


the Prophet said:
"Do not be people without minds of your own, saying that if others treat you
well you will treat them well and that if they do wrong you will do wrong;
but accustom yourselves to do good if people do good and not to do wrong if
they do evil."
[Tirmidhi 5129]

I know you didn't ask when a Muslim is allowed to kill another Muslim, but I thought this might be related. I came across it in Imam al Nawawi's "Complete Forty Hadith".


Abu Mas'ud, may Allah be pleased with him, said "The Messenger of Allah, may Allah bless him and grant him peace, said, "The blood of a Muslim man is not permitted (to be shed) except for one of three: the adulterous mature person (who is or has been married), a person (killed in retaliation) for (the killing of) a person, and one who abandons his deen and seperates himself from the community."
Al-Bukhari and Muslim narrated it.




If you are familiar with this already, then ok, if not let me know and I'll post the Imam's commentary up too. Although to be honest it's not a great commentary in this case.
