Asalamu Alaikum,

I was having a converasation with another sister and we were discussing the iddah of a women after she gets divorced.

My question is, is it ok for a women to meet with her walli and a prospective husband before her iddah is over? They would not be getting married but just meeting each other as a possability, since we know that to get married during the iddah is haram?

Jazak Allahu Khair to all who can help. Also, please provide the daleel to back your answers.

As salaamu alaykum, Bismillah was salaat was salaam ala'rasulillah, before we can answer the question you posed it must be clear that the husband still has a right to take his wife back {provided that she also agrees} as long as it is not a irrevocable divorce {i.e. it is not a divorce whereby he pronounced three talaq, so therefore he cannot be with her until she remarries. This is based upon Allaah statement (interpretation of the meaning): “The divorce is twice” [al-Baqarah 2:229], i.e., revocable divorce. Then Allaah clearly states that if the husband divorces her again, she is not permissible for him unless she marries another husband. So that inshallah the differenciation between these two types of talaaq should clear.
  As for the issue at hand: Allah clearly states in the Quran that it is impermissable for a man to be straightfoward about his intention with regards to a woman he wants to marry who is in her iddah.  

"And there is no sin on you if you make a hint of betrothal or conceal it in yourself, Allâh knows that you will remember them, but do not make a promise of contract with them in secret except that you speak an honourable saying according to the Islâmic law (e.g. you can say to her, "If one finds a wife like you, he will be happy"). And do not consummate the marriage until the term prescribed is fulfilled. And know that Allâh knows what is in your minds, so fear Him. And know that Allâh is Oft-Forgiving, Most Forbearing." [al-Baqarah 2:235]

Which in our times would mean he can't sweat the sister or "try to make {halal} moves on her" {muchless she sweating him}, rather he has to "drop it cool" until her iddah ends and his turn comes, then they can bounce from there with the wali. Hence shaikh Munnajid says {islam-qa.com shaikh}:

"The hinting to which Allaah attaches no blame is only in cases where a woman is irrevocably separated, whether by her husband’s death or a third talaaq or an annulment of the marriage. Clearly stating a marriage proposal is not permitted, but statements which may mean a marriage proposal or may mean something else are OK. But if a woman has been divorced by revocable talaaq, then it is not permissible to propose marriage to her, whether clearly or by hinting, because she still comes under the rulings of wives. This aayah also indicates that it is haraam to enter into a marriage contract with a woman who is still in her ‘iddah, because if it is haraam to propose to her, it is more so to draw up the marriage contract. If this takes place, the contract is invalid."

Just to point out why i thought it would be significant to this post -

In reference to the above question it stipulates (and as well as  colaborates Br / Sr Assings reply : "The Quran prohibits a direct proposal of marriage to a women observing Iddah and a man is allowed to give only a veiled hint of his desire to marry a pious women - {Surah Al-Baqarah-235}.  It is therefore not permissible to even propose to her or become engaged whislt obeserving Iddah"

About the booklet, I found it to be very interesting & informative as it deals with all aspects of death starting from "what to do to a person on whom the signs of death are clearly seen" and includes every and any practical knowledge one should have at such times.

Very useful and helpful knowledege that we should ALL be made aware of.
