As Salaamu 'Alaikum,

A Sister  :-)I know is getting married.  Her intended lives in the neighboring state.  She says that she is getting married over the telephone.  I have heard this going on for the past year but when I ask where it derived from I cannot get an answer.  Can anyone give me proofs on the authenticity of this type marriage.  Does it come from the Qu'ran, Hadeeth, Fiqh ???

Why would the woman have to be at the wedding?

If the wali is speaking for her and giving the brother her responce, there is no reason for her to 'have' to be there.

Prophet Muhammad (saw) married one of his wives Umm Habibah, when she was in Habasha and he was in Madinah. Still, there should be a valid reason behind doing this I suppose.

My ex-room mate did his nikah on phone too.

While agreeing with brother momineqbal I'll like to add something that it's advised that man and woman should see each other before getting married. In case of Umm Habiba or Sauda (rau) (please correct me if I am wrong) Holy Prophet  [saw] and Sauda (rau) knew each other for long time so there was no need to see each other before getting married.

But if the sister and brother and stranger for each other then it might be better that they see each other before getting married on phone or through wali.

what  you  said  is  a  personal   recommendation . but  the  SHARIAH  allows  marriage  to  take  place  through  waly . this  is  one of  the  flexibilty  of   ISLAM  to  make  the  road  easier  for  sisters and  brother  not  to  face  obstacles  that  can  cancel  the  marriage .
