Bombing suspects freed then three rearrested

The State has withdrawn charges against five terror suspects who were charged with the murder of 15 people in last year's bombing of Mombasa's Paradise Hotel.

Three of them were rearrested and charged with conspiracy to commit a felony, an offence that carries a maximum of seven years imprisonment.

The three, Mr Kubwa Mohamed Seif, Mr Said Saggar Ahmed and Mr Salmin Mohamed Khamis were taken to the chief magistrate's court were they took their plea.

They were charged that on or before August 7, 1998 in Mombasa, Lamu and Nairobi, they, jointly with others not before the court, conspired with intent to murder by means of bombing the American Embassy in Nairobi.

The second count was that of conspiring with intent to commit murder by shooting down an Israeli aircraft at the Moi international Airport in Mombasa on November 28 last year. They pleaded not guilty to the charges.Their case will heard on January 7 and 8.  

Deputy chief State counsel, John Gacivih, told the court that the State has decided to withdraw murder charges against Mr Faiz Abdalla Shariff and Mr Mohammed Ali Hassan on basis of age.

Mr Gacivih said he was instructed by the Attorney-General Amos Wako to withdraw the charges against the three suspects strictly in view of the evidence available.

Mr Shariff who sat for his Kenya Certificate of Secondary Education exams this year, is said to be 17 years old.

The remaining four out of the previous nine are still on murder charges. Their cases have been consolidated.  

They are Mr Aboud Rogo Mohammed, Mr Mohammed Kubwa, Mr Omar Said Omar and Mr Mohamed Ali Saleh Nabhan.  

Lady justice Kalpana Rawal set the case against the four for hearing on January 26.
