Danish Muslim Dismissed for Wearing Headscarf Loses Court Case (Islamweb) Financial Times COPENHAGEN, Denmark -- Europe's controversy over the wearing of Islamic headscarves took a new twist yesterday when Denmark's high court ruled against a supermarket cashier who was sacked for wearing a hijab. The precedent-setting judgment, which runs contrary to earlier Danish court rulings, is likely to trigger further heated debate about the rights of immigrant communities in Denmark, where there have been tensions. Integration of Denmark's immigrants, roughly 7 per cent of the population, was the main theme in general elections which brought a centre-right administration into power. The case began two years ago when Najla Ainouz, a 25-year-old woman of Moroccan origin, lost her job at a Copenhagen supermarket because she covered her hair. Her employer, the Fotex supermarket chain, said her headscarf breached its established dress code, which also bans prominent Christian symbols as well as gaudy hair colorings and nose rings. Ms Ainouz disagreed and, with the backing of her trade union, sued Fotex for unfair dismissal under Danish anti-discrimination law. "I want to go to heaven and I won't do so if I don't wear my headscarf," she told the court. Fotex, part of Denmark's second-largest supermarket group, DSG, has about 28,000 employees, 7 per cent of whom come from an immigrant background. This roughly reflects the proportion of immigrants in the Danish population as a whole, and the court therefore ruled that Fotex had not tried to evade its obligation to ensure equal treatment regardless of ethnic origin. HK, the trade union that pursued the case on Ms Ainouz's behalf, was bitterly disappointed and said it would appeal to the Supreme Court. "This does not take cognizance of Europe's human rights convention that gives everybody the right to practice their religion and religious beliefs," said Jorgen Hoppe, an HK director. Yesterday's ruling came just one day after DSG bowed to public pressure and lifted a ban on another type of headgear - seasonal Santa Claus hats. [slm] i heard on the radio yesterday that Germany will be following with the no scarves policy yesterady. Something to do with it being legislated soon and that teachers will not be allowed to wear scaves? Can our Muslims Brothers and Sisters in Germany spread some light on this please, Insha Allah? |

assalamu'alaikum wa rahmatu allahi wa barakatuh I am in favour of total "neutrality", I wanna see a ban of every religious and secular symbol, method of reasoning etc :)) it should be forbidden in school, work, everywhere, to express any kind of view that is related to be either secular or religious, agnostic, atheistic or yedda yedda yedda :) long live neutrality. ah, hey, perhaps I should send lexicon to france and denmark, cause those fools dont seem to understand the definition of the term they use :)) now I shall go and ban myself :o wasalaamu |
