On Eid we were at K-mart. While I was in the housewares, Ali found $60 in the ATM cash machine. He actually went and turned it in to the front desk, with out my intervention. In fact I did not know about it until we drove away.

slm,

I remember once seeing a 500 lira note lying around on the eid fairgrounds in syria... I went to pick it up and the girl I was with almost jumped me.. She is studying fiqh there and was saying that once you pick it up it becomes a duty upon you to find the owner and you have to go through as much as you can within reason to find him/her. Then only after a year and exhaustive search and you haven't found the owner, THEN you can keep it :)

But I guess if you're in a place give it to the lost and found of wherever you found it.....

From what I have heard from ulema (including syrian ones) after an year it is pereferable to give it away with the intention of the reward for the charity going to the rightful owner.

If it is a durable good, (like a leather jacket) and a year has elapsed with no one claiming it, then you can use it with the intention that if one day the owner returns you will give it back.

In short I have heard scholars say that anyone who knows the fiqh of "lost-n-found" never picks anything up!

My father tells me that when he was a kid if someone lost even a single coin, and went looking for it a day after, he would find it on some ledge or safe place nearby. People would pick it up and leave it where it wouldn't get trampled under the feet.

I would concur with al-anon. One person said to me once that if you picked up the money and then the owner went back on his tracks to try and find his dropped money, you would be the reason why he wouldn't find it. So if i see money lying on the floor i just leave it and walk on by.

I left my purse in a Dunkin Donuts a couple of months ago, in a tough neighboood. Imagine my surprise when we went back and someone had found it at the table...and turned it in to the counter.

If they had left it, Allahu Allum, perhaps a thief would have taken it.
Not debating the words of Sheiks... just an observation in these days and times.

My response was concerning something found in open public spaces like roads, parks etc.

Generally in masjids, shops, resturants one turns in the found item to the administration as the person looking for it is bound to ask them if he returns.
