As'salamu Alaikum

As im new to islam i still have a few questions.  I was talking to mu non-muslim friend the other day about islam etc, she accepts that im muslim now and dosnt have a problem with it, she was asking me questions etc and one thing she said kind of stuck in my head and I could really do with peoples comments on this please.  She said to me "Ok so wen you take the Shadadah all my life before me was wiped clean, all sins forgiven etc" I said yes, she said ok and carried on with another conversation.....then she said to me "So what if a man/woman had jus been jailed for murder as a non-muslim, then found his/her way to islam and took the shadadah.  What she wanted to know was would that person be forgiven for the murder that he had commited as a non-muslim???

I couldnt really answer her question what she had asked me.....can anyone answer for me please. I think its a really good question she asked me and I would like to give her a honest answer.

After the Shahada, people are forgiven for absolutely everything they did before they were a Muslim inshallah. Since they didn't believe in Allah or worship him as Islam perscribed, their actions weren't deliberate disobedience to Allah, right.

Ask her if she believes that God can forgive one's sins if a person repents. In Islam even if you ARE Muslim and you commit murder and you sincerely ask for forgiveness following all the guidelines and conditions then you will be forgiven for it inshaAllah. Allah says He will forgive every sin except shirk as long as we are doing everything correctly.  So even though murder is like the #2 major sin after shirk and the Quran describes one person being killed as killing all humanity, know that His forgiveness has more breadth than the heavens and the earth.

And if a person commits murder with the intention of becoming Muslim then of course God knows!!! And He also knows who is sincere or not and who has fulfilled all the conditions like giving back the person their right, asking for forgiveness, feeling regret, vowing never to commit the sin again etc..

so in conclusion Islam is a very practical religion with a lot of flexibility taking in people's nature.

Thankyou for the replies, but dont you think that the person has commited this sin be punished anyway?? Even if they have embraced islam? This is a major sin and i dont think they should be given forgivness, they should be punished for taking anothers life.

Just think if it was a son/daughter/sister/brother etc who had been murdered....would you want the murderer not to get punished? Because i surley would!

Would you like your sins to be forgiven uksara? Or should they be set in stone no matter what? Should people be punished for sins they have sincerely repented for?

There are some people in the world that deserve forgiveness and Allah knows them. Would Allah guide an evil wrongdoer killer who will never change to Islam? Their accepting Islam and changing their life is their repentance. Allah has more compassion than human beings eh... God forbid we were ever in charge of justice.. we would just be all about revenge and getting back at others. There are those who would like the chance for God to forgive their sins. If they are worthy enough, why shouldn't He forgive them?

Your friend sounds like they think becoming Muslim is like a 'get out of jail' free card. It's not like that. They need to think about the wider picture and they need to udnerstand that Allah, God KNOWS everything and is the controller of the universe and He does lead people to Islam so that their sins are forgiven.

You should talk to someone in jail who has found Islam.. they are like different people.. In fact, ask them to read The Autobiography of MalcolmX...

First, the punishment for murder in Islam is not to be put in jail.  So the question itself is flawed.  If a non-Muslim committed murder in an Islamic state, and it was proven that he did so, then he would face one of two possibilities:

1. Be executed
2. Pay blood-money to the family of the deceased.

If he/she accepts Islam after murder, but before the sentence is carried out, he/she would *not* be executed by the Judge.  He would be forgiven and released.  However, the blood-money would still be due to the family of the deceased, and I believe it'll have to be paid by the National Treasury.  So that's how they would be compensated.  This is kind of similar to a case where someone kills someone else by accident.  In this case, the murderer is not executed, but pays blood-money.  However, I believe (and I may be wrong) that in the scenario you have given he wouldn't even pay blood-money, but rather it would be the Treasury which would provide compensation to the deceased.

However, this is the general rule, and you have to consider several things here: The one who accepts Islam would most likely do it with sincerity, and would be extremely remorseful for what he did (i.e. murder).  If this wasn't the case, and the murderer accepted Islam just to get away from the punishment, and it became evident to the Judge that this was the case, then he would still be executed.  If, however, he hides it and the judge doesn't find out, then he still has to live with the fact that he's a Muslim for the rest of his life.  He cannot turn back any more, because apostacy would result in a severe punishment from the Judge.  So converting to Islam *just* to save your life is not really a wise cop out for anyone.

Alternatively, if the Judge sees that this trend is becoming rampant in society, that people are using conversion as a cop out to free themselves from being punished, and that they are really not accepting Islam, then he may decide to carry out the prescribed punishments regardless of people converting.  This is something that the judge can do based on the circumstances of his society.  Islamic Law is not set in stone.   It adapts to the circumstances of people, as long as the purpose of the Law is fulfilled, and the Judge is knowledgeable and God-fearing.

However, all of this is really hypothetical and quite unlikely! :)
